What RO e-Factura actually requires
Romania made structured e-invoicing through a single government channel (SPV) the only valid way to invoice between RO taxable persons. Here is what that means for you in practice.
Established RO entities must comply
Since 1 July 2024, RO e-Factura is the sole legal channel for B2B invoices between taxable persons established in Romania. A PDF or paper invoice between such entities is no longer a valid invoice — this applies to foreign-owned Romanian SRLs exactly as it does to local ones.
Receiving is an obligation too
Your suppliers send their invoices into SPV as UBL XML. You must pull, read, reconcile and retain them. Recording a B2B invoice from a RO-established issuer outside e-Factura carries a separate 15%-of-invoice-value penalty.
60 days in SPV vs. 5 years to keep
ANAF keeps the XML in SPV for roughly 60 days, then it is no longer downloadable. Yet you are legally required to retain each invoice for 5 years. SPV is a transmission channel, not an archive — the gap is yours to close.
Late or missing transmission is fined by taxpayer category — 1,000–2,500 RON for small taxpayers, 2,500–5,000 RON for medium, and 5,000–10,000 RON for large — plus a separate 15% of invoice value for recording a B2B invoice from a RO-established issuer outside the system. These figures reflect the regulatory state through mid-2026 and are general information, not legal advice.
